Welcome to Imaanity (“we,” “us,” “our”). These Terms of Use (“Terms”) govern your access to and use of our website, mobile applications, and related services (collectively, the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms. These Terms apply to all users, including both individual donors and charitable organizations (collectively, “Users”).
If you do not agree to these Terms, please do not use the Platform.

  1. About Imaanity

    Imaanity is a digital platform designed to simplify purposeful giving—from Zakat to everyday acts of charity—to verified causes, communities, and faiths. We serve both individual donors and charitable organizations by enabling donations through our Platform.

  2. Eligibility

    • Individuals must be at least 18 years old, or the age of majority in their jurisdiction, to use the Platform.
    • Organizations must be duly registered, eligible to receive charitable donations, and authorized in their jurisdiction.
    • By using the Platform, you confirm that you meet these eligibility criteria.
  3. User Responsibilities

    A. Individual Donors

    • Use the Platform lawfully and ethically.
    • Provide accurate, current, and complete personal and payment information.
    • Do not engage in fraudulent or unauthorized transactions.
    • Understand and adhere to our Donation and Refund Policy (Section 6).

    B. Charitable Organizations

    • Ensure listed causes are truthful, compliant with applicable law, and updated regularly.
    • Directly use donations for the specified, legitimate purposes.
    • Cooperate fully with Imaanity’s verification, compliance, and fundraising checks.
    • Promptly notify us of status changes (e.g. loss of charitable registration).
    • Comply with applicable data and privacy protection regulations when processing donor information

    We reserve the right to suspend or terminate the access of any user who violates these Terms or applicable law.

  4. Imaanity’s Role

    Imaanity is strictly a technology facilitator. We are not a charity; legal ownership of any donation remains with the donor until transferred. We process donations to verified charities and issue receipts as required by law.

  5. Fees & Payment Processing

    Imaanity does not charge any platform fees. 100% of your donation goes directly to the selected cause.

    However, payment processors and financial institutions (such as Paystack, Stripe, PayPal, or banks) may charge standard transaction or processing fees for secure payment handling.

    • These fees are treated separately and are not deducted from your donation amount.
    • Any applicable payment processing fees will be clearly displayed before you confirm your donation so you know exactly what you are paying.
    • Donations remain non-refundable once the transaction is completed, except under specific conditions outlined in our Refund Policy.
    • Payments are processed securely through trusted third-party gateways. Imaanity does not store your full payment details.
  6. Donation & Refund Policy

    • Irrevocability: Donations are final and irrevocable once processed, except as permitted under our refund policy.
    • Refund Eligibility: Refunds are considered in exceptional cases, such as technical errors or duplicate donations, and only if the funds have not yet been transferred to the recipient charity.
    • Refund Process: Refund requests must be submitted within 30 days via [email protected] . Approved refunds will be returned to the original payment method within 5–10 business days.
    • Funds Transfer: Once transferred, refunds are only possible through the receiving charity directly (subject to their own policies).
    • Funds may be redirected to a comparable, verified charity if disbursement is not possible due to ineligibility or compliance concerns.
  7. Receipts, Tax & Donation Allocation

    • Donations are allocated to approved charitable accounts; charities must maintain accurate banking details.
    • Charities are responsible for any applicable sales, withholding, VAT, or other taxes on donations received.
    • By accepting donations, charities assume liability for compliance.
  8. Privacy & Data Sharing

    • Your personal data (name, contact, email) are treated per our Privacy Policy.
    • Unless donating anonymously, donor details may be shared with recipient charities to enable proper acknowledgment, reporting, or legal compliance.
    • Charities must handle any donor personal data responsibly and in accordance with applicable data laws (e.g., NDPR, GDPR).
  9. Updates to these Terms

    • We may revise these Terms at any time. For material changes, we will notify Users via the Platform or email 14 days before changes take effect.
    • Continued use after notification implies consent to the updated Terms; Users may terminate their accounts if they choose not to accept changes.
  10. Suspension, Termination & Refunds

    • We may suspend or terminate access at our discretion, with or without notice, for any breach, suspected fraud, or violation of law or policies.
    • Termination does not waive obligations or liabilities accrued prior to termination.
    • If we terminate a charity access, we may redirect donations to another qualified charity consistent with donor intent and applicable law.
  11. Representations & Warranties

    • Each User represents and warrants that:
      • They are eligible and legally authorized for transactions supported by the Platform.
      • Provided impersonation, donation, or fundraising information is accurate and lawful.
      • They will not misuse Imaanity’s intellectual property or confidential systems.
    • Users agree to indemnify Imaanity and hold us harmless from any claims, damages, or losses arising from their use of the Platform or violation of these Terms.
  12. Disclaimers & Limitations of Liability

    • To the fullest extent permitted by law, the Platform is provided “as‑is” and “as‑available.”
    • We disclaim all warranties, whether express or implied, including fitness for purpose or non-infringement.
    • We will not be liable for indirect, incidental, special, consequential damages (e.g., lost profits, data loss), even if aware of the possibility.
    • Nothing in this section limits liability for fraud, willful misconduct, or gross negligence.
  13. Governing Law, Dispute Resolution, and Arbitration

    These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict‑of‑law principles.

    Any dispute, claim, or controversy arising from or relating to your use of the Platform or these Terms shall first be resolved through informal negotiations within 30 days of written notice.

    If no resolution is reached, the dispute shall be referred to binding arbitration in Nigeria, under the Arbitration and Conciliation Act of Nigeria, before an arbitrator appointed by Imaanity.

    • The arbitration shall be conducted in the English language.
    • The venue of arbitration shall be determined by Imaanity, and the arbitral award shall be final and binding on all parties.
    • Imaanity reserves the right to seek interim or injunctive relief in any court of competent jurisdiction in Nigeria to protect its rights, intellectual property, or confidential information.

    By agreeing to these Terms, you waive any right to participate in a class action, consolidated, or representative proceeding against Imaanity.

  14. Third‑Party Integrations

    • We may integrate third-party services (e.g., payment processors, tax services). Use of such services is subject to their terms—not these Terms.
    • We are not liable for third-party performance, errors, or breaches of their own agreements.
